CONDITIONS OF EMPLOYMENT
This position has requirements which must be met prior to employment, and conditions for continued employment. Your answers to the questions in this section will indicate your understanding of, or possession of, these requirements and conditions.

This position requires the incumbent be able to obtain and maintain a determination of eligibility for a Secret security clearance or access for the duration of employment. A background investigation and credit check are required. Are you willing to undergo pre-employment and recurring investigations to obtain and maintain a Secret clearance as required?

Financial Disclosure Statement OGE Form 450 is used to assist agencies and employees to avoid conflicts between duties and financial interest. This position requires pre-employment financial disclosure and annually thereafter in accordance with DoD Directive 5500-7-R. Are you willing to disclose your financial affiliations prior to employment and annually thereafter to obtain and maintain employment in this position?

Appointment to this position is subject to a two year probationary period unless the appointee has previously met the requirements as described in 5 CFR Part 315. While probationary the incumbent can be terminated with limited appeal rights. Are you willing to serve a two year probationary period?

This position has a Temporary Duty (TDY) or business travel requirement of 10% of the time. Are you willing and able to travel away from your permanent duty station up to 10% of the time?

This position requires the incumbent to possess a Good Standing Certificate. Official certificate and/or letter showing that you are a member in good standing of the bar. Certificate must be dated within three months of the date the application is submitted. Copies of bar cards are not acceptable replacements for the certificate and/or letter. The Certificate of Good Standing must be submitted by all applicants, to include attorneys currently appointed to positions under ANY qualifying authority of the Judge Advocate General, Army, Chief Counsel, Army engineers, Command Counsel, Army Materiel Command or General Counsel, Army (including active duty Army Judge Advocates). Fitness to Practice Statement - A sworn (notarized) statement from you that your fitness to practice law or conduct as an attorney has never been challenged in any jurisdiction to the best of your knowledge, or if either has been challenged, a sworn (notarized) statement concerning the facts and circumstances, together with any explanation that you may deem appropriate may be submitted. As an alternative to a sworn, (notarized) statement, a declaration under penalty of perjury may be submitted in the following format: "I declare (or certify, verify, or state) under penalty of perjury under the laws of the United States of America that the foregoing is true and correct, executed on (date) (your signature)". (28 U.S.C.1746). The Fitness to Practice Statement must be submitted by all applicants to include attorneys currently appointed to positions under ANY qualifying authority of the Judge Advocate General, Army, Chief Counsel, Army Engineers, Command Counsel, Army Materiel Command or General Counsel, Army (including active duty Army Judge Advocates).

Applicants must have successfully completed a full course of study in a school of law accredited by the American Bar Association (ABA) and have the first professional law degree (LLB or JD).

Applicants must currently be a member in good standing of the bar of a state, territory of the United States, District of Columbia, or Commonwealth of Puerto Rico.

Applicants must have two or more years of professional legal experience, acquired after being admitted to the bar, commensurate with the duties and responsibilities of the position. Graduation from an ABA-Accredited Law School in the top 25% of the class or an advanced law degree such as an LLM may substitute for one year of the required professional legal experience.
