1. General Eligibility Requirements - Are you currently enrolled in an accredited degree-seeking program in pursuit of a LL.B, J.D., or equivalent training, in your third year of study and scheduled to complete your course of study by the spring/summer of 2023?

Are you a full-time graduate law student expected to graduate in spring/summer of 2023. Your graduate study must have immediately followed law school graduation with no significant post- J.D. employment and must be full-time for the duration of study?

You are a Judicial Law Clerk prior to the application deadline and will complete your clerkship prior to September 30, 2023. Your clerkship must be your first significant legal employment following your graduation and, generally, must begin no later than seven months post-J.D. You may serve in a single one or two-year clerkship or in two consecutive one-year clerkships. Your clerkship may be no more than two years in duration.

Note: Transcripts must be submitted to verify education. If transcripts (official or unofficial) are not submitted, candidates will not be deemed eligible for this position.

2. Qualifying Education and Experience [Law Clerk (GS-11)] - Will you possess the first professional law degree (LL.B. or J.D.) or equivalent training by Summer 2023? Equivalent training is training permitted in some States in lieu of attendance at law school. To be accepted, this training must be of the kind and nature required by the State in which the bar examination is taken or will be taken.
- AND-
Possess evidence of superior law student work or activities, demonstrated by one of the following:
1. Academic standing in the upper 30 percent of the law school graduating class.
2. Special high-level honors for academic excellence in law school, such as election to the Order of the Coif.
3. Participation on law journal.
4. Winning of a moot court competition or membership on the moot court team which represents the law school in competition with other law schools.
5. Other equivalent evidence of clearly superior achievement. Other qualifying experience may include: one year of professional non-legal experience at the GS-9 level or equivalent. Examples of this non- legal experience include:
a. Experience as an Equal Opportunity Specialist or Paralegal Specialist.
b. Full-time or continuous participation in a legal aid program, as opposed to onetime, intermittent, or casual participation.
c. Significant summer or school-year law office clerk experience.

Instructions for Program of Interest: This recruitment will be used to fill positions in four Program Offices within Equal Employment Opportunity Commission (EEOC).  Questions 5 - 10 are related to the assignments within each of these offices. 5. Assignment of Interest (All Program Areas): Are you interested in participating in the Attorney Honors Program within any Program Area? (limit characters)
6. Assignment of Interest within the Office of Field Programs: The participant may be assigned to the National Hearings Program, part of the Commission's Office of Field Programs, where they will gain valuable employment law experience under the guidance of the EEOC's Chief Administrative Judge and other senior leaders. The participant will draft critical process standards, conduct informational meetings, and make recommendations to senior leaders. The participant will also manage their own docket of prioritized cases, and in doing so will review federal agency investigations of discrimination complaints, examine discovery, conduct legal research, hold conferences, and assist in drafting decisions in individual and class action cases. The participant will also work directly with administrative judges on the adjudication of their cases. A successful participant must possess strong analytical, decision-making, and oral and written communication skills; the candidate should also be comfortable using various legal research databases.

7. Assignment of Interest within the Office of Federal Operations: The participant may be assigned to the Office of Federal Operations which works to advance America's ideal of equal opportunity for more than 2 million federal civilian workers and bring positive change to the nation's largest employer in various ways. This assignment will give participants experience to:
  • Hone your legal research and writing skills by writing published appellate decisions that decide discrimination cases.
  • Enact government-wide affirmative employment policies.
  • Conduct cutting-edge employment research.
  • Become a skilled public speaker by training thousands to prevent employment discrimination.
Participants may also work temporarily at another federal agency to develop new skills. The Office of Federal Operations is seeking self-driven candidates who excel at legal research and writing; can devise creative and innovative solutions to complex legal issues and policy challenges; possess leadership qualities; are collaborative and can work well with others; are passionate about civil rights; and have an interest in public service.

8. Assignment of Interest within the Office of General Counsel (litigation in federal district court): The participant may be assigned as a trial attorney with EEOC's Office of General Counsel. Participants will handle the full range of responsibilities for preparing and litigating employment discrimination cases in federal district court, under all statues enforced by the EEOC. Participants will be part of a legal unit in an EEOC district. Participants will advise and assist investigators, draft litigation recommendations, and file suit. You will conduct discovery including working with claimants, taking and defending depositions, and requesting and producing documents. Participants will work with expert witnesses in complex cases. Participants will research, draft, and file and argue motions in court, litigate discovery disputes, conduct oral arguments, negotiate settlements, and conduct jury and bench trials. As an attorney with Appellate Litigation Services, you will represent the Commission in the federal courts of appeals in enforcement actions brought by the Commission and in cases where the Commission appears as amicus curiae on legal or policy issues. Preferred participants will possess interest in conducting litigation in federal district court (up to and including jury trials).

9. 10. Assignment of Interest within the Office of Legal Counsel: The participant may be assigned within the EEOC Office of Legal Counsel (OLC) which seeks an attorney with exceptional writing and research skills to help with drafting regulations, guidance, and technical assistance for Commission consideration. The successful participant will also have opportunities to perform work for OLC units that negotiate Memoranda of Understanding with outside entities and otherwise coordinate interagency matters, defend the agency from suits concerning the agency's policies and operations, and advise the agency on a wide range of legal matters. After experiencing work from across OLC, the successful participant will be placed in the unit that best suits OLC's needs and the attorney's strengths. In addition to writing and research skills, relevant factors for selection may include relevant coursework, demonstrated interest in civil rights, and experience working with EEOC-enforced laws.
