14. Have you been convicted of engaging or attempting to engage in sexual activity facilitated by force, overt or implied threats of force, or coercion, or where the victim did not consent or was unable to consent or refuse, or have you been civilly or administratively adjudicated to have engaged in such activity? 16. Seniority dates are determined and adjusted based on qualifying service as a BPA. Any breaks in service must be utilized to recalculate your seniority date. Breaks in service means you actually left the Border Patrol and then came back. Time spent under suspension, LWOP due to workers compensation or LWOP due to military duty are NOT breaks in service. Transfers to other agencies (like the Federal Air Marshals or Immigration and Customs Enforcement) ARE examples of breaks in service.

For example, you were a Border Patrol Agent from 5/22/2012 to 5/2/2013. On 5/3/2013 you took a position as a Customs and Border Protection Officer. You were reinstated as a Border Patrol Agent on 5/2/2014. Your seniority date on 5/2/2014 is now 5/1/2013 (Please note that when calculating your seniority date separations are effective at midnight of the effective date. For each period of service, the day of the separation must be credited. This can be done by: adding a date to each separation date, OR adding the number of separations to the days being subtracted from the appointment date, in the above example you would have served 1 year and 1 day as a Border Patrol Agent, with the allowance of one day for the date of separation).

Please provide your seniority date with U.S. Border Patrol in the 1896 series. This date will be used to rank you with your peers.

Employees who misrepresent their Seniority Dates will be ineligible for relocation for four years.
